Agreement to Participate
The Registrant understands and agrees that neither the Doors Open Oshawa organizing committee nor The Corporation of the City of Oshawa assume any liability or responsibility for any injury to Visitors or the Site, or for damages to the Site, or for theft of contents from the Site resulting from or during the Doors Open Oshawa Event. It is the Registrants responsibility to ensure theat the building is adequately insured for damage, theft and public liability. It is also the responsbility of the Registrant or their agents to clean the Site, open the Site at the agreed date and time, not charge admission during the Event, ensure safe conditions for Volunteers and Visitors, and provide a staff supervisor during the Event (if possible).
The Registrant shall at all times defend, indemnify and save harmless the City from and against any and all actions, causes of actions, charges, claims, costs, damages, debts, demands, expenses, fees (including legal fees), indebtedness, judgments, lawsuits, legal proceedings, liabilities and losses which may be brought against or made upon or incurred by or suffered by or imposed on the City due to or in any way related to the Registrant’s participation in Doors Open Oshawa 2025, including, but not limited to, its volunteers and tours, activities, displays and items for sale planned for the site during Doors Open Oshawa 2025.
Insurance:
For the duration of the Event, the Registrant shall procure and maintain a Commercial General Liability (CGL) insurance policy written on an occurrence basis with a liability limit of not less than Two Million Dollars ($2,000,000) occurrence with the City named on the policy as Additional Insured without any rights of subrogation, and shall contain a cross liability and/or severability clause which protects each insured to the same extent as if they were separately insured. The CGL policy coverage shall include, but is not limited to, third party bodily injury including death, property damage, personal injury, advertising liability, products and completed operations (the “Policy”). The Policy shall be taken out with an insurance company licenced to carry on the business of insurance in Ontario and shall be endorsed to provide that the City is to receive not less than thirty (30) days’ notice in writing in advance of any cancellation, material amendment, or change restricting coverage.
The Registrant shall verify that valid insurance coverage as set out in this Agreement is in place by submitting an Insurance Certificate to the City at least ten (10) days prior to the Event, which must be acceptable in all respects to the City.
